Areas of Intervention 
1. Training and professionalization

Workers:    

 

The Ministry of Labor participates in an inter-institutional project created through the Care Board, to promote the certification of skills for people dedicated to care and promote access to formality.     

 

Employers:  

 

The Ministry of Labor provides training indirectly through the promotion of their measures and implementation modalities, through the media. 2. Dissemination and awareness-raising 

The Ministry initially launched an informative video titled “Domestic Work Formalization Guide, Ministry of Labor” that details all the steps to follow to register an employment contract, as well as the rights of domestic workers within that employment relationship as well as an instructional guide that can be found on the domestic worker registration portal. Likewise, through the Social Networks, the Ministry launches information campaigns to apply the harmonization resolutions of Convention 189 and the application of the Minimum Wage for the sector.  

3. Inspection 

The body of labor inspectors has maintained constant training and unification of criteria, to strengthen the inspection work with the objective of reaching the application of Convention 189 and harmonization measures.  

 

As well as, they were trained in a good management of the registration portal for domestic workers and on the Domestic Work Guide, with a view to serving as multiplier pilots.  

 

It is important to highlight that, on the domesticas.mt.gob.do, there is a written contract model, a letter of referral to the Ministry of Labor model, and a guide.  

 

Also, Resolution 14-2022 mentions that the Ministry is “in charge of ensuring compliance by employers and workers with this resolution, always respecting the right to privacy and the inviolability of the home”.  

 

The labor inspector is a promoter of labor harmony through conciliation, which is why the first phase in dealing with a complaint is to summon the parties for the purpose of reconciling and solving differences through dialogue.   

4. Social Security Coverage   CNSS Resolution No. 551-08 establishes in the pilot plan the necessary mechanisms for the inclusion of domestic workers in the Dominican Social Security System, under the Subsidized Contributory Regime, which is a fixed contribution scheme charged to the employer, worker, and the state. They also have survivorship pensions for the direct dependents of the domestic worker. Consult here. 
5. Alliances with social actors 

The Ministry of Labor has maintained constant dialogue with representatives of domestic worker movements, participated in the gathering of information for the purposes of preparing the portal for the registration of domestic workers and in the recommendations for the harmonization measures of the Convention 189.  

 

And in the same way, they have been trained with workshops on rights and duties and on the application of the resolutions that regulate this sector.  

 

Before issuing Resolution No. 14-22 on the adoption and harmonization of measures related to the improvement of compliance with Convention 189 of the International Labor Organization (ILO), which began the implementation of Convention 189 in the Dominican Republic, it was brough to public hearings, and both this and those referring to the establishment of the minimum wage and access to social security were socialized and approved in a tripartite manner, that is, promoting collective bargaining and harmony between the parties.

Domestic workers are protected by maternity, they can’t be fired for being pregnant; It is required to request authorization from the Ministry of Labor and to be in the presence of a cause that is enshrined in Art. 88 of the Labor Code, so that dismissal can be authorized for just cause.
